SMS Terms of Service

What Gust sends, how often, to whom, and what it does not promise.

The service

Gust sends automated SMS messages to two named members of one family about one child's sailing sessions out of Marina del Rey, California. A GPS tracker on the boat reports its position; when the boat crosses out past the harbour breakwater, or returns to the dock at his sailing club, a message goes out saying so.

That is the whole service. It is private, it is unpaid, there is nothing to buy, and it is not available to anyone outside this family.

Consent

Both recipients asked to receive these messages and gave their mobile numbers directly to the operator, in person. There is no public sign-up, no web form, and no list that anyone was added to without asking.

Message frequency. Up to three messages per sailing day; typically fewer than ten per month. Nothing is sent on days when nobody sails.

Message and data rates may apply. Your mobile carrier's normal charges for receiving text messages apply; Gust does not charge anything.

To stop, reply STOP to any message. Reply HELP for help.

Mobile numbers are never shared with any third party for any purpose. See the privacy policy.

What we do not promise

This is a convenience, not a safety system, and it should not be relied on as one. It depends on a GPS tracker having battery, a cellular network being reachable from a small boat a mile offshore, a self-hosted server staying up, and a carrier delivering a text — any one of which can fail without warning. Messages may arrive late, arrive out of order, or not arrive at all.

Nobody should ever be in a position where a text message from this site is the only thing standing between a child and being left on a dock. Arrangements for collecting him should work whether or not the message arrives.

Carriers

Mobile carriers are not liable for delayed or undelivered messages.
